PREAMBLE

The site is owned by the seller, ODYSSEUM, whose registered office is located at: 1544 avenue Salvador ALLENDE - 83300 Draguignan, registered at RC 827 972 100.

The following provisions are intended to define the terms of sale on the site www.odysseum-protect.com

These Terms and Conditions (hereinafter "GTC") define the contractual rights and obligations of the seller and his client in connection with distance selling and electronic goods and products.

The Terms exclusively govern the relationship between the vendor and the customer.

The Terms constitute the entire obligations of the parties. The customer is deemed to accept without reservation, otherwise the order will not be validated.

If in doubt on one of the conditions of sale, the procedures in force in the distance selling sector by companies whose registered office is in France and the Consumer Code apply.

The seller reserves the right to modify the Terms punctually. The changes will be effective upon posted.


ARTICLE 1. CATALOGUE OR ONLINE STORE

Through the site, the seller provides the customer a catalog or an online store with exactly the products sold without the photographs have a contractual value.

ARTICLE 2. Prices

Prices are quoted in euros (excluding VAT and taxes included) and does not include delivery charges, which are charged extra. Shipping fees are indicated before validation of the order by the customer.

The prices include taxes applicable on the date of the order and any change in the rate of these taxes will be reflected in the price of the product catalog or online store. If one or more taxes or contributions, in particular environmental, were to be created or modified, up as down, this change will be reflected in product sales prices.

The total amount of the order (including taxes) and shipping costs included, is shown before final validation of the order.

Payment of the full price must be made when ordering.


ARTICLE 3. ORDER ONLINE

The customer has the option of completing an online order, by means of an electronic form. By completing the online form, the customer accepts the price and description of products.

The customer must accept by clicking where indicated, these general conditions of sale, so that the order is validated.

The customer must provide an email address and a valid shipping address and acknowledges these terms and conditions of sale any exchange with the seller may act through this address.

The customer will choose the shipping method and validate the method of payment.

ARTICLE 4. CONFIRMATION AND PAYMENT ORDER

This is an order with payment obligation, which means placing the order implies a customer's payment.

4.1 PAYMENT

The customer makes the payment at the time of the final validation of the order by specifying the credit card number.

The vendor has implemented an order check procedure and payment methods reasonably designed to ensure against unauthorized use of a means of payment, including asking the customer identification data.

In case of refusal to authorize payment by credit card by the accredited bodies or in case of non-payment, the seller reserves the right to suspend or cancel the order and its delivery.

The seller reserves the right to refuse an order from a buyer who has not fully paid or a previous order or with whom a payment dispute is ongoing.

4.2 CONFIRMATION

Upon receipt of the validation of purchase and payment by the customer, the seller transmits to the latter, the email address he has specified, confirmation of receipt of the order and a copy of the contract to print.

The seller is required to send an invoice to the customer upon delivery.

The client can request the sending of the bill to another address than delivery by addressing a request to that effect to the customer service (see contact information below) before delivery.

In case of unavailability of a product, the seller will keep the client informed by e-mail as soon as possible to cancel the order of this product and pay the related price, the rest of the order remaining firm and definitive.

The customer can assert his right of withdrawal within 14 days from the time the information about the unavailability of the product was sent to him.

ARTICLE 5. ELECTRONIC SIGNATURE

Accordance with the provisions of Law No. 2000-230 of 13 March 2000, the online provision of the buyer's credit card number and the final validation of the order as proof of the customer's agreement to the enforceability of amounts due under the order, signature and express acceptance of all operations.


ARTICLE 6. PROOF OF THE TRANSACTION

Communications, orders and payments between the customer and the seller will be proven through the records stored in the seller's computer systems in reasonable security conditions. Purchase orders and invoices are archived on a reliable and durable considered, particularly as a means of proof.


ARTICLE 7. PAYMENT

All forms of payment available to the customer are listed on the seller's site. The customer guarantees the seller that he has the required permissions to use the payment method chosen by him, when placing the order.


ARTICLE 8. SHIPPING

The delivery is made after confirmation of payment by the Seller banking organization. Included in these costs packaging, handling and postage.

Packages are generally shipped within 10 working days after receipt of payment, except for orders placed during high peak periods, where this warranty does not apply. The shipping mode is the Colissimo off without signature or via Relais Colis for delivery of orders in France.

The times indicated are target dates, corresponding to the average processing time and delivery. ODYSSEUM the Company will not be held responsible for consequences due to delayed delivery are not of his making. The possible delays do not entitle the buyer to claim damages.

Orders placed on Friday, Saturday and Sunday will be shipped on Monday.

8.1 LATE DELIVERY AND TERMINATION

In case of late delivery, the seller will inform the customer, which may cancel the contract and request a refund within 14 days of the notification.

The total refund of the product and delivery charges, or redirected if necessary, is then carried out.

8.2 CHECKING THE CONTROL

If the time of delivery, the original packaging is damaged, torn, open, then the client must check the condition of the products. If they were damaged, the buyer must imperatively refuse the parcel and note a reserve on the delivery.

The customer must indicate on the delivery order, and in manuscript form, any anomaly concerning the delivery.

Any reservation not made in the rules defined above and on time will be taken into account and release the seller from any client vis-à-vis.

Upon receipt of the claim, the seller will allot a number of exchange of the product (s) concerned (s) and communicate by e-mail to the customer.

8.3 DELIVERY ERROR!

In case of error of delivery and / or non-compliance of products in relation to entries on the order form, the customer chooses to claim from the seller the same day of delivery or later than the next business day the delivery.

Any claim not made in the rules defined above and on time will be taken into account and release the seller from any client vis-à-vis.

8.4 CONTROL BACK

The product for exchange or refund will be returned to the seller as a whole and in its original packaging, as follows:

Any claim or return not made in the rules defined above and within the time limits could not be taken into account and release the seller from any client vis-à-vis.

Any product for exchange or refund will be returned to the seller as a whole and in its original packaging. The return costs are borne by the customer.


ARTICLE 9. GUARANTEES PRODUCTS

The seller guarantees the product conformity with the contract.

The customer can make a request under the legal guarantee of conformity in accordance with Articles L. 211-4 of the Consumer Code, or under the liability for defects of Article 1641 of the Civil Code.

It is indicated to the client that the seller is not the producer of all products featured within the meaning of the Act No 98-389 of 19 May 1998 concerning liability for defective products.

9.1 WARRANTY OF FITNESS

The customer has a period of 2 years from the delivery of the product to implement the legal guarantee of conformity.

As such, he can choose between repair or replacement of the goods in accordance with Article L. 211-9 of the Consumer Code.

The customer is not required to prove the existence of a lack of conformity, within 6 months (24 months from March 18, 2016, except for used goods) from the date of issue of product.

9.2 WARRANTY DEFECTS

The client, if he uses the liability for defects under section 1641 of the Civil Code, can choose the resolution of the sale or a price reduction, in accordance with Article 1644 of the Civil Code.


ARTICLE 10. UNAVAILABILITY PRODUCTS AND REIMBURSEMENT

In case of unavailability of a product ordered, the customer will be informed by email.

The customer will have the option to cancel the order and will thus have a choice between a refund of amounts paid by him within 30 days at the latest of their payment, or exchange the product.



ARTICLE 11. RIGHT OF WITHDRAWAL

The customer can assert his right of withdrawal and return the product within 14 working days of delivery.

After communicating its decision to withdraw, the customer then has 14 days to return or restitution.

Any withdrawal or return not made in the rules defined above and within the time limits could not be taken into account and release the seller from any client vis-à-vis.

The customer can request an exchange or refund of the returned product, without penalty, except for return costs shall be borne. However, in case of exchange, delivery charges can again be charged to the customer.

The return or exchange the product will be accepted for products in whole, intact and in their original state, especially with a complete packaging intact and sales.

Some products, due to their intrinsic quality, can not be subject to the withdrawal right, and can not be reimbursed, including but not limited to the products covered by Article L. 121-21-8 of the Consumer Code to know :

- Any perishable product

The seller will refund the customer the full amount paid, including shipping costs, within 14 days of the recovery of property or transmission of proof of the shipment of such goods.


ARTICLE 12. DATA PROTECTION

The seller will retain in its computer systems in reasonable conditions of security proof of the transaction involving the purchase order and the invoice.

The seller guarantees the client the protection of personal data of the latter.

The seller made to this effect a declaration to the CNIL under number 1937154

ARTICLE 13. MAJOR FORCE

The parties will be exempted from their obligations in case a circumstance beyond their control, constitutes a case of force majeure, would prevent their execution. The parties' obligations will be suspended.

The party invoking such circumstances shall notify the other party immediately upon its occurrence and disappearance.

Are considered as force majeure any compelling facts or circumstances, outside parties, unpredictable, inevitable, independent of the will of the parties and which can not be prevented by them, despite all reasonable efforts, defined as such by the French jurisprudence, including the blocking of means of transportation or supplies, earthquakes, fires, storms, floods, lightning, and stop telecommunication networks.

If the force majeure lasts more than three months, these terms may be terminated by the injured party.


ARTICLE 14. PARTIAL NULLITY

If one or more provisions of these terms of sale were to be declared null by law enforcement, regulation or a final decision of a French court, other provisions shall remain in full force and effect.


ARTICLE 15. APPLICABLE LAW AND JURISDICTION

The seller has lived in France for a stable and sustainable way to effectively carry out his activity, whatever, in the case of a corporation, the location of its headquarters.

Also, these Terms are subject to the application of French law to the exclusion of the provisions of the Vienna Convention.

In case of dispute or complaint, the customer should first contact the seller for an amicable solution.

Failing amicable agreement, the customer, he contracted as a consumer, can initiate proceedings before the court of his choice and he contracts as a professional, may initiate proceedings before the court where the seat social seller.
